Abstract

Law has been considered a secondary issue in Marxist criticism. This is due to some specific factors – firstly, because Marx himself did not devote specific pages to the topic, although he was quite sharp and clear in his observations about the nature of the law; and, especially, due to a mistaken perception about the instrumentality of law. After all, it is well known that the political strategy of the dominant classes involves the co-optation of legality and the institutional occupation of jurisdictional bodies and that, on the other hand, the struggles for emancipation seek, not infrequently, the conquest of new and broader social rights. It is in this environment that Celso Naoto Kashiura Jr.'s work, Subject of Law and Capitalism, proves to be strikingly relevant.
