Abstract

In Marxism, humanism and law: Althusser and Garaudy, Juliana Paula Magalhães takes up the theoretical debate that took place within Marxism about theoretical humanism, more specifically, the debate between members of the French Communist Party Roger Garaudy, defender of the thesis according to which the Marxism is a “concrete” humanism, and Louis Althusser, defender of the thesis according to which Marxism is a science of history (and society) that arises from the rupture with humanist ideology. The author makes this return with a precise objective: to relate the different positions with the critique of legal subjectivity. Her main argument is: humanist positions remain in the field of the ideology of subjectivity and, at the limit, legal ideology, which is based on the subject of law, which, in turn, is a reflection of the human essence.
