Abstract
Our article presents the main content of the following Evgeni Pashukanis’ unpublished texts: Towards an exam of the literature about general theory of law and state (1923), Ten years of Lenin’s The state and revolution (1927), Un exam of the main currents of French literature about public law (1925), The nature of the state according a bourgeois jurist (1921), Preface to Russian edition [of M. Hauriou’s Principles of public law] (1929) and The soviet state apparatus in the struggle against bureaucratism (1929). In these writings, there are huge contributions not only to Marxist critique of law itself, in a complementary sense to the content of The general theory of law and marxism, but also to the development of a more rigorous Marxist thinking about the state and its connection with legal form in what concerns both capitalism and socialist transition.
